    72 HOUR HEALTH GUARANTEE

At the time of receiving your new puppy, we provide a 72 hour health guarantee and has received a verterinary examination, age appropriate vaccinations as well as deworming. Purchaser will be provided with all health records of the puppy while the puppy was in our care. The Purchaser is responsible for taking the puppy to a veterinarian within 72 hours for a complete exam and any expenses involved. If the veterinarian finds that the puppy has a life-threatening hereditary condition, which will keep the puppy from living a normal life span, Breeder will replace the puppy with another one of similar value that is or will become available. Normal puppy maladies, (examples: parasites, worms, ear/eye infections, fleas, mites, ringworm, giardia, or coccidia) are not covered as they are common in dogs and puppies. This guarantee does not cover minor physical defects (examples: navel hernias, cherry eye, uneven bites, undescended testicles, inability to reproduce, inability to qualify for shows, size or conformation, class I or II murmur, pan osteitis, hip or elbow dysplasia, glaucoma, eye problems, intervertebral disc disease, back problems, luxating patella, or any other non-life threatening problem). Breeder is not responsible for any puppy transported by third party service/courier and said transport is not liability of breeder.

Under no circumstances shall the Breeder be liable for any consequential, incidental, or special damages resulting from negligence and environmental factors (ex: temperament, bloat, allergies or any other autoimmune system disorder). Breeder will not be responsible for contagious diseases after 48 hours of the pup leaving Breeder’s home (ex: parvo, distemper, cornona virus (kennel cough), mange, lepto, or scabies) these are highly contagious and can be contacted immediately after leaving our home from many sources. Breeder’s puppies are given the best care possible while at Breeder’s home and it is the Purchaser’s responsibility to continue to provide due care, and not expose an unprotected puppy whose vaccines have not yet taken effect to contagious situations.

If something is found seriously wrong with the puppy, a written statement from the veterinarian must be sent to Breeder stating the puppy's condition and a copy of the veterinarian's report is required. Breeder will not be responsible for any illness, temperament, or health problems genetic or otherwise, which are diagnosed after the 72-hour guarantee. This guarantee becomes null and void if Purchaser has not taken the puppy into a licensed veterinarian within 72 hours of receiving the puppy. If the puppy dies within the 72-hour time frame, an autopsy must be done by a veterinarian to determine cause. If it is determined the puppy had the condition before Purchaser took possession and a copy of autopsy is provided with veterinarians’ signature, Breeder will replace the puppy. If no autopsy is provided this guarantee is void. A second opinion can be requested by the Breeder at the Purchaser’s expense from a non-associated veterinarian. Breeder will not be responsible for any medical bills pertaining to your puppy once it leaves Breeder’s home. Puppies are sold pet quality and are intended for the purpose of family pet. If something is found under the terms above to be wrong with the puppy and a replacement puppy is wanted, then the sick puppy and all paperwork must be returned within a 48-hour period at the Purchaser’s expense for guarantee to be valid. (Breeder does not under any circumstance cover any cost of getting said puppy back to Breeder or getting the replacement puppy the Purchaser.) If no puppies are available in the current litter, Purchaser will be notified of the next planned litter. Guarantee is for replacement only; no cash refunds are given. Breeder cannot guarantee if and when Breeder will have a puppy of the same color or sex. If Purchaser wishes to keep the puppy rather than wait on another puppy, then this guarantee becomes void. The Breeder reserves the right to grant extra time or modify the agreement provided both parties agree. Any such agreements shall be done in a manner that offers proof, such as email, text, writing or fax. No verbal agreements will be made. Purchasing a puppy indicates that the Purchaser has read, agrees, and does understand all the conditions of the Health Guarantee. If any of the above terms have not been met by Purchaser this contract is considered void. Again, anything that is diagnosed or develops after the 72-hour period is the responsibility of the Purchaser.

RIGHT OF RETURN TO BREEDER CONTRACT

The Purchaser agrees that if their circumstances change and they need to surrender the puppy/dog at any time that they will contact the Breeder and give the puppy /dog back at no cost to Breeder. Purchaser will also return all medical records back over to Breeder as well. If Breeder places the puppy/dog in a new home for any type of monetary profit, 3/4th of the monies accrued will be transferred back to the original Purchaser of the animal after it has been re-homed within 30 days of the return. After 30 days any monetary profit returned to the original Purchaser will be reduced by 25% per month. The other will be kept by Breeder to balance the cost of care and board of the dog. If any veterinary care is needed when Breeder receive the dog. Breeder will keep the cost of veterinary care as well. Any monies past those two amounts will be sent to the original Purchaser. No Monies will be sent back unless/until puppy/dog is re-homed. The Purchaser shall never abandon this dog, transfer to a shelter, sell/transfer to a research center, or sell/transfer it to a pet shop. If it is found that Purchaser have transferred ownership of the dog, in any way, without written approval from Breeder, Purchaser will pay to the Breeder the original cost of the dog plus $500 for breach of contract.

SEVERABILITY. If any provision of this agreement is held in whole or part to be unenforceable for any reason, the remainder of that provision and of this agreement shall be severable and remain in effect.
